Regulation

Germany applies the EU Markets in Crypto-Assets Regulation to crypto-asset service providers. BaFin describes the authorisation process, permitted exceptions and ongoing supervisory obligations. An applicant must identify the actual services it plans to deliver, including custody, exchange, execution or advice. The legal treatment of a token also matters when it falls within another financial-services regime.

Exchange verification

Search the exact contracting company in BaFin’s company database and the ESMA MiCA register. BaFin’s database shows authorised activities and relevant cross-border notifications. Match the entity, service and website with the agreement presented during account opening. A familiar trading name can cover several legal entities with different permissions.

Tax and record keeping

Germany’s Federal Finance Ministry updated its crypto income-tax guidance on 6 March 2025. The guidance distinguishes income categories and expands documentation duties. Acquisition dates, disposals, fees, rewards and transaction valuations belong in the record. Private disposals, business income and rewards need separate analysis. The ministry expressly states that NFTs and liquidity mining remain outside that guidance’s coverage.

Starting a business

Prepare a service map, governance structure and complete application before relying on an authorisation timetable. BaFin first assesses completeness and may request missing information. Its published guidance states that application fees depend on work undertaken. An authorised provider can use the MiCA cross-border notification route for EU services.

Banking and payments

During bank selection, ask how the account will handle exchange settlements, client funds and the proposed currencies. Document the distinction between company operating cash and customer assets. Confirm the payment partner’s identity and permission in the company register, then request written onboarding requirements for the intended transaction flow.
