Regulation

The Malta Financial Services Authority supervises entities under the Markets in Crypto-Assets Act, Chapter 647. Its crypto framework covers service providers and the relevant categories of issuers. Issuing a token and operating a custody or trading service raise different obligations. Begin with the token’s characteristics and the service the customer receives.

Exchange verification

Search the MFSA Financial Services Register for the exact company and inspect its permission. Cross-check the ESMA record when researching EU market access. Use the approved entity name when comparing an exchange’s account terms, custody arrangements and complaints procedure. Record the verification date because permissions and legal entities can change.

Tax and record keeping

Malta’s tax administration publishes guidance on income-tax treatment of DLT assets, issued in 2018. Use it to identify the relevant transaction and asset questions, then confirm the current treatment of the particular arrangement. Separate investment holdings, trading receipts, compensation and token issuance in the records. The regulatory label attached to a business does not by itself supply its tax calculation.

Starting a business

The MFSA describes authorisation as an assessment whose conditions must continue to be met during operation. Prepare governance, capital, safekeeping, outsourcing and complaints arrangements for the services sought. Its crypto page also provides reporting requirements. Budget for the people and systems that will operate those controls after the initial application.

Banking and payments

Ask potential banking partners to assess the planned customers, jurisdictions, currencies and settlement flows. Obtain their documentation requirements early. Use a separate working diagram for company funds and customer funds, showing the banks, payment providers and custodians involved in each transfer.
