From research to a working plan.
Regulation
Portugal’s Law 69/2025 allocates MiCA responsibilities between Banco de Portugal and the securities regulator CMVM. The law assigns provider authorisation and several prudential matters to Banco de Portugal, with conduct and market-related responsibilities allocated to CMVM. Research the competent authority for the particular activity before preparing an application.
Exchange verification
Check current MiCA authorisation and cross-border permissions through ESMA and the Portuguese authorities. CMVM publishes provider information including authorised services. Record the contracting entity, its home state and the services it may perform. Historical virtual-asset registration should be checked against the current MiCA record before selecting a provider.
Tax and record keeping
Article 10 of Portugal’s personal income-tax code includes a 365-day holding-period exclusion for specified crypto disposals, together with other conditions and definitions. It also addresses exchanges receiving crypto as consideration and departure from Portuguese tax residence. Establish the asset category, holding history, residence and applicable conditions before relying on a tax outcome. Keep the full chain of swaps and acquisition records.
Starting a business
Map the proposed service against MiCA and Portugal’s allocation of supervisory duties. Prepare the corporate structure, responsible managers and outsourcing relationships so both prudential and conduct questions can be answered. Establish which authority handles the application and which requirements apply to the customer-facing activity.
Banking and payments
Build a documented euro payment route before committing to a launch date. Ask the chosen bank and payment provider about exchange transfers, client-fund accounts and transaction evidence. Maintain a ledger linking bank movements to the corresponding crypto transactions, including fees and changes of wallet.
