Verifying a US crypto provider across federal and state records

CryptoGov Research Desk · Sources reviewed 1 November 2026

01 / LOCAL CONTEXT

Avoid the single-registration shortcut

FinCEN MSB registration is not a blanket government approval of a crypto platform. Start with the entity named in the agreement and the service being provided. Record your state and the places where the company says it can serve customers. An exchange group can operate through different subsidiaries with different permissions.

Use the official record appropriate to each claim rather than accepting a screenshot of a registration certificate. Build a table with the entity, identifier, relevant authority, activity and date checked. Flag any mismatch between the agreement and the name in the record instead of resolving it by assuming they are equivalent.

02 / WORKING CHECKLIST

Use New York as a concrete example

NYDFS explains that FinCEN registration does not remove a relevant BitLicense requirement. Its published material distinguishes virtual-currency licences from approved banking-law charters and notes that other permissions may still be needed. For a New York relationship, check the specific legal entity in the DFS regulated-entity information.

For another state, establish the applicable state checking route rather than importing the New York answer. Ask the provider to identify the basis on which it supplies the proposed service there. A clear response should name the entity and status; a generic assertion that the group is compliant does not answer the question.

03 / WORKING CHECKLIST

Check the account’s practical boundaries

Read custody, withdrawal, complaint and insolvency terms alongside the register findings. Identify the company handling dollars and the company controlling tokens. If a new product is offered inside the same interface, repeat the service analysis. Interface continuity can conceal a different contractual relationship or a different legal scope.

Save the official entries and dated terms in a single evidence file. Independently verify contact details and watch for clone domains. Recheck after changes to customer location, agreement or entity. The process makes regulatory claims inspectable while leaving commercial, security and market risks visible as separate decisions.

Sources & scope

Official sources support the jurisdiction context. The working checklists are CryptoGov’s editorial preparation suggestions, not an exhaustive application or filing requirement. Confirm the rules and your circumstances before acting.
