Identify the claimed regulatory capacity
The FCA supervises in-scope UK cryptoasset businesses under the money-laundering regime. Its guidance says registration is a requirement for relevant activities, not a recommendation. Find the legal entity in the customer contract and record what status it actually claims, instead of accepting a broad statement that the brand is regulated.
Build a short table comparing the company name, company identifier, service and official record. Check whether the agreement redirects customers to another group entity. If it does, repeat the checks for that company. A parent, payment affiliate or unrelated service licence does not automatically establish the status of the crypto account.
Keep promotions and operating permissions separate
The financial-promotions regime can apply to firms marketing cryptoassets to UK consumers regardless of where the firm is based. Ask which lawful route supports the promotion you received. Do not infer that the promoter is a fully authorised crypto investment business merely because a communication has passed through an approval process.
For the proposed product, record who executes transactions, who holds assets and who processes fiat payments. Read complaints and withdrawal clauses. Look for conditions on customer residence and account type. These details expose whether the service you expect is actually delivered by the entity whose registration you checked.
Keep the check usable over time
Save the dated official record and the version of terms offered to you. Independently verify contact details and be alert to clone websites. A familiar name can be copied by another operator; the domain and contractual company need to agree with the evidence, not just resemble a recognised business.
Recheck after a new product, entity migration or material terms update. Mark unanswered questions explicitly and retain the provider’s response. This process cannot eliminate commercial or custody risk, but it prevents a common mistake: allowing one accurate registration statement to stand in for several different questions about the account.
Sources & scope
Official sources support the jurisdiction context. The working checklists are CryptoGov’s editorial preparation suggestions, not an exhaustive application or filing requirement. Confirm the rules and your circumstances before acting.
